Understanding
the agency’s legal duties is the basic information for defining agency
operations including the level of service offered to customers. While the legal duties may serve as a minimum
baseline it is important for agents to know how their actions above the legal
duties may have an impact on the standard of care owed to customers. To gain a deeper understanding of differing
agent duties and standard of care in each state* the Big “I” Professional
Liability Program and Swiss Re Corporate Solutions surveyed panel
attorneys. Each attorney was asked to
